EC presents roadmap on the revision of the IPR Enforcement Directive

The European Commission has published a roadmap outlining the current status of the proposal for a revision of Directive 2004/48/EC  on the enforcement of intellectual property rights (IPRED). The roadmap provides information about the progress of the review, the main objectives of the Commission and an overview of most discussed issues concerning the IPRED framework. The Commission intends to finalize the review of IPRED in the spring of 2012.

The main incentive to update the Directive is that the internet and digital technologies have added a new dimension to enforcement of intellectual property rights. After a public consultation, early 2011, a number of other issues have been raised. Certain provisions of the Directive 2004/48/EC may not be sufficiently clear and lead to diverging interpretations by Member States and the national courts. This Roadmap lays out the main problems of the IPR Enforcement Directive 2004/48/EC and provides a comprehensive view on the way forward as envisaged by the Commission.
