Perfect10 loses lawsuit against Google

A U.S. judge ruled that Google may continue to show pictures of the porn site Perfect 10 if they are relevant for the searcher. The right holder of these pictures does not have to agree with this, according to news from the Dutch news website Nu.nl 

So what is going on? Google indexes the footage of Perfect10 and shows the material in a small size in Google Image Search. According to Perfect10 they suffer damages from subscribers who distribute the images on other websites. These websites are also indexed by Google and shown in Google Image Search.  Perfect 10 was however not able to demonstrate the financial damages that would be caused by Google as they could not find anyone who terminated the Perfect10 subscription due to Google Image Search. Therefore, the financial damages that would be caused by Google could not be demonstrated. Previously, Google had already won the case and now again in appeal. 

As the Future of Copyright reader knows, Perfect 10 has a long history of lawsuits. Perfect 10 is originally known as the publisher of porn magazines, but nowadays they appear to focus on filing copyright lawsuits. Previously, they have filed lawsuits against MegaUpload and RapidShare.
