Aim4Music forbidden to distribute Dutch music

Dutch online music platform Aim4Music.nl is forbidden to any longer sell music works from the Dutch Buma/Stemra’s repertoire. Thus is the outcome of a lawsuit between TargetMedia, owner of the website since two years and collecting society Buma/Stemra. TargetMedia has without permission from Buma/Stemra made available online musical works by its members during a two year period. The distribution of copyrighted (music) works without permission from the owner is an infringing activity under the Dutch Copyright Act, and thus unlawful.

The judge has apparently given TargetMedia until September 5, 2011 to make an agreement with Buma/Stemra and to pay the over due license fees. After that date, the owner of Aim4Music forfeits a penalty of € 5,000 per day (with a maximum of € 25,000). TargetMedia is also oblidged to pay the procedure costs of over € 11,000.

It is not yet known if TargetMedia will appeal.
