RapidShare dodges copyright allegations again

A German court ruled that file-hosting service RapidShare does not infringe game producer Atari’s copyrights by making its computer games available online. The entertainment industry considers RapidShare a pirate’s haven by facilitating the violation of copyrights on a large scale. 

Spokesman Daniel Raimer said that RapidShare is operating completely legal and has taken measures against the misuse of its service. “We are confident that copyright holders will gradually come to accept this conclusion." (…)

Despite many lawsuits in countries around the world, judges have not established that RapidShare violated copyrights. Furthermore, the company is not liable for the behaviour of its users, as they usually agree to delete files upon request of a copyright holder. 

Videogame producer Atari was concerned about the distribution of its game Alone in the Dark through RapidShare, and wanted the hosting service to take responsibility for blocking such downloads before they become available online.

A lower Düsseldorf court had sided with Atari, but RapidShare appealed the decision and won. “The additional measures required by Atari are unreasonable and pointless," said RapidShare.
