Usenet portal FTD twice in Dutch court over copyright infringement this week

Yesterday (October 5th) the case between Usenet portal FTD and Brein took place before the Court of Haarlem, the Netherlands. It will of course take some time before the actual verdict, but both parties have taken a stance. FTD demands a declaratory judgment that its actions are lawful. Brein demands an injunction against FTD on the grounds of committing or facilitating copyright infringement, thereby referring to the controversial verdict in the legal proceedings between Dutch film production company Eyeworks and FTD.

Earlier this year the judge of the court in The Hague ruled that FTD was directly infringing Eyework's copyright by pointing out the download locations of Eyework's movie 'Komt een vrouw bij de dokter' to its members. The verdict caused quite a stir, because previously in similar cases judges ruled that such platforms aren't infringing copyright themselves, but are committing a tort by facilitating copyright infringement (by others). The appeal of FTD in the case against Eyeworks will take place on Thursday before the court of The Hague.
