BREIN wants court to ban The Pirate Bay's site in the Netherlands

Today, BREIN has asked a court of law to rule in favour of a ban on The Pirate Bay’s website in The Netherlands. Not only the current three owners have been summoned: the future owner also has to make his appearance.


In spite of the current owners having been tried in Sweden for being accomplishes to copyright infringements on a grand scale, the site is still in the air. Director of BREIN Tim Kuik: “The Netherland’s court has repeatedly affirmed that continuously using the availability of unauthorised content with a website or web-based service is against the law. The Pirate Bay is for 85% about illegal content and that is where people use it for.


The future owner, Sweden based Global Gaming Factory (GGF), has also been sent a summons despite it’s announcement to aim running The Pirate Bay in way respecting copyright. That is a precautionary measure. “We are avid supporters of legal utilisation of the Internet and are therefore very pleased with the intention that the GGF has announced,” says Kuik. However, he emphasises that much still remains unclear about the take-over. GGF did make clear its intent to use The Pirate Bay for legal distribution, but little is known about the way they plan to do this. That is why BREIN aims to have a judge rule pre-emptively that The Pirate Bay needs to cease it’s operations until they prevent structurally allowing access to protected content.
